Comtech Subsidiary Files Patent Lawsuit vs. Radyne

 

MELVILLE, N.Y., June 20, 2006/Satnews Daily/ — Comtech Telecommunications Corp. (NASDAQ:CMTL) said on Monday that its Tempe, Arizona-based subsidiary, Comtech EF Data Corp., has filed a patent infringement lawsuit against Radyne Corporation in the U.S. District Court for the District of Arizona.

 

Comtech in its lawsuit accused Radyne of willfully infringing on Comtech’s U.S. Patent No. 5,666,646 entitled "Radio Frequency (RF) Converter System with Distributed Protection Switching and Method Therefor" by selling and offering for sale certain of its frequency converter products.

 

The patent covers a valuable RF converting system using "daisy chain" switching and eliminating the use of a centralized switching unit. In the lawsuit, Comtech EF Data Corp. seeks an injunction preventing Raydne from further misappropriating Comtech EF Data Corp.'s technology.

 

Comtech is also seeking unspecified monetary damages arising from the company's unauthorized use of the patented technology and disclosure of users of the infringing products.

 

Comtech EF Data Corp. had previously filed a lawsuit against another company for infringing on Patent No. 5,666,646, which resulted in that company withdrawing its product from the market.

 

Responding to the allegations, Radyne in a press statement said that they had already filed a response to the lawsuit filed by Comtech EF Data saying the claim is without merit and invalid.

 

In the filing with the court, Radyne denied that the switching technology used in its converters is covered by the Comtech EF Data patent and further claims that the patent itself is not valid.

 

“Radyne does not employ the technology described in Comtech's patent which itself covers a method that has been widely used in the industry for years,” said Bob Fitting, Radyne's CEO. “Although the business affected by the claim is not significant to Radyne, we believe it is in the best interest of our customers to defend this lawsuit,” he said.
